Agreement

These terms of service are the only valid agreement between you and Authenticators R US, This agreement comes into effect once the Company agrees to perform an authentication and you, the client, has paid the price of the service, subject to our right to withdraw our services in accordance to our terms herein,

Services

Authenticator R US agrees to submit an authentication within one Day (24 hours) after the Client has submitted their order for an evaluation, provided you have submitted all photos and information required to complete the authentication, within the 24 hour time frame. Should we have to request additional information or photos, this can cause a delay. While our goal is to complete your order within the 24 hour time frame, this is not always possible due to extenuating circumstances. Should the authentication exceed 24 hours due to requests for additional information, or unforeseen circumstances, Authenticators R US shall not be obligated to issue a refund to the client.

Cost for Services

Prices are in accordance with the price list as specified on our order page. Authenticators R US reserves the right to raise or lower prices at any time, depending on individual orders. Payments are to be made with PayPal only.

Client's Responsibilities

The client, after paying for their service must provide clear photos of the item in question, along with any and all information about the item, such as purchase history, seller information, date of purchase, or any helpful information or knowledge you can obtain. Should we have to request further information, this can cause a delay in your service. The client recognizes that an authentication is a skilled opinion and opinions may differ . We can only give our professional opinions based on the photos and accuracy of the information you, the client, provides us. If you, the client, do not agree with our evaluation, we encourage you to get a second evaluation. We are not responsible for inaccurate images or incomplete information, All photos requested must be clear and of the exact item in question. The client agrees to answer all email requests from the company in a timely manner.

REFUNDS

AUTHENTICATORS R US

Will refund the fee only if we are not able to authenticate the item in question.
Special discounted services are non-refundable.
We do not refund based on the outcome of the evaluation the client is hoping for, or if the client does not provide requested photos. Should the client not respond to photo and information requests within 14 days of the date of request, we will declare the order null and void based on lack of communication, photos and information. The client will be notified by email of any cancellation.

This Website contains proprietary property of Authenticators R US, which is protected by copyright and other laws respecting propriety rights. Authenticators R US retains all rights in the material or media, including, without limitation, all copyright and other propriety rights worldwide in all media. You may not use the name 'Authenticators R US. or our logo, except as expressly permitted under this agreement and under U.S. copyright laws.

The Authenticators R US Logo is copyrighted and trademarked. Anyone found using the Authenticators R US seal on an unregistered and approved website will be held liable and fined a fee to be determined by the court. Unpaid fines will be collected by whatever legal means necessary.

End users who are duly authorized may view the information on screen, may download small portions to a computer for personal convenience and later reference, and may print copies of small portions for personal use only.

The rights granted herein are an expansion of the rights granted under the Copyright Act and do not include any right to reproduce in it's entirety any portion of the information or materials contained therein. No part of the information may be duplicated in any medium or format beyond the express terms of this agreement. without prior written authorization from Authenticators R US. Any use not authorized by the agreement is prohibeted and is not allowed under U.S. Copyright laws.

You acknowledge that the information and licensed materials contained herein is highly proprietary in nature and that unauthorized copying, transfer or use may cause , Authenticators R US and / or it's suppliers, irreputable injury that can not be adequately compensated for by means of monetary damages. You agree that any breech of this provision, by you or any subscriber, or any end user, may be enforced by Authenticators R US, and / or any of it's supppliers, by means of equitable relief, including but not limited to injunctive relief, in addition to any other available rights and remedies.

Authenticators R US Liability

The Company, Authenticators R US, shall not be liable for any extenuating circumstances or events that occur as a result of one of our authentications, such as disputes between sellers and buyers, switch backs of items purchased, etc.. We can not be responsible if a seller sends you any item that is not authentic, as we can not control if the seller sends you the same item that was evaluated in the listing. Authenticators R US will not be liable for items authenticated by our company in any manner, whether it be from a selling Client or a buying Client. The company has no control of what items are actually purchased or sold, as to what is delivered they may differ from the photos and information provided by the client. We can not be responsible or liable for clients not providing full and accurate photos and information, that can not be identified, and could cause deficiencies in our evaluation.

Agreement Termination

Should the Company breech the agreement with the client as described in this Terms of Service, or fail to provide an authentication, the client is entitled to terminate this agreement by written , email request, and the client shall be refunded the price paid for the evaluation. Special discounted services are non-refundable. Refunds will be sent directly back to your PayPal account. .Termination of this agreement shall cause the authentication to be revoked and the client shall destroy any information or authentication given to them by the the Company.

CLIENT SHALL INDEMNIFY THE COMPANY AND ITS AUTHENTICATORS, EMPLOYEES AND OFFICERS AGAINST ALL LIABILITIES AND EXPENSES INCURRED BY THEM AS A RESULT OF ANY BREACH OF THIS AGREEMENT OF ARISING FROM RELATED CLAIMS BY THIRD PARTIES IN CONNECTION WITH THE AUTHENTICATION SERVICE PROVIDED. Should the Client breach this Agreement by using the authentication for prohibited or illegal purposes,
1) the Agreement shall be terminated with immediate effect and the Client shall not be entitled to a refund on the price paid for the authentication,
2) the company's license to the authentication shall be revoked, and
3) the Client shall destroy the authentication.
There shall be no further liability of the Company to the Client from the date of termination of the Agreement.

Severance

In the event that any part of the Agreement should be held to be unenforceable for any reason, that term shall be deemed to be not part of the Agreement, the remaining portions of the Agreement shall remain in full force and effect.

Force Majeure

Neither party shall be liable in damages or have the right to terminate this agreement for any delay or default in performing here under if such delay or default is caused by conditions beyond its control including but not limited to acts of God (such as but not limited to fires, explosions, earthquakes, drought, title waves and floods); wars or hostilities, insurrections, revolutions, civil war, invasions, or acts of enemies (whether war be declared or not); riots, strikes, lock-outs or disorder; acts or threats of terrorism; and/or any other cause beyond the reasonable control of the party whose performance is affected (including mechanical, electronic, or communications failure).

Acceptable Use Policy

You are independently responsible for complying with all applicable laws in all of your actions related to your use of Authenticators R US, regardless of the purpose of the use.

Warranties

THE AUTHENTICATION IS PROVIDED TO YOU ON AN "AS IS" BASIS WITHOUT ANY WARRANTIES OF ANY KIND. THE COMPANY AND THE AUTHENTICATORS PERFORMING THE AUTHENTICATION, TO THE FULLEST EXTENT PERMITTED BY LAW, DISCLAIM ALL WARRANTIES WITH REGARD TO THE AUTHENTICATION, INCLUDING WITHOUT LIMITATION, THE WARRANTY OF MERCHANTABILITY. THE COMPANY AND ITS AUTHENTICATORS MAKE NO WARRANTIES ABOUT THE ACCURACY, RELIABILITY, COMPLETENESS, OR TIMELINESS OF THE AUTHENTICATION. YOU ALSO AGREE THAT YOUR SOLE AND EXCLUSIVE REMEDY FOR OUR PREPARATION OF THE AUTHENTICATION WILL BE YOUR CONTRACTUAL RIGHT TO A RETURN OF THE FEES YOU PAID TO US FOR THE AUTHENTICATION.

Acknowledgement

Authenticators R Us, LLC, acknowledges, that we are in no way affiliated with the designer brand name companies we evaluate . The brand names are the sole rights of their perspective trademark owners. We do not represent any of the designers names we place on our Certificates of Authenticity, nor do we work for any of the designer companies we evaluate. We base our evaluations on years of studying, research, collecting, owning , catalogs and saved research materials and knowledge. Our evaluations are opinions only, and are not related to any trademark companies. We acknowledge that our company is not accepted by any of the brand names we evaluate as their source for authentications and that we are not affiliated with these designers in any way. It is our intention to only protect our clients from unlawful purchases or sales in the illegal counterfeit industry. Authenticators R Us has helped to take down countless counterfeit websites off of the internet and will continue to protect any and all trademark brand rights. We are totally against any trademark violations caused by criminal counterfeiters and will continue to report them as well as protect our clients from purchasing or selling any of their counterfeit goods.
